LAS TARJETAS REVOLVING Y UNA SENTENCIA
El Tribunal Supremo indicó en una Sentencia el 25 de noviembre de 2015, que el interés generado por las tarjetas revolving es una práctica usurera y podía ser declarado nulo.
Este mes de noviembre, un juzgado de la localidad alicantina de La Vila, distingue entre la nulidad del contrato de estas tarjetas y la acción de reintegro. El fallo condena al banco digital WiZink con la nulidad del contrato, tal y como pedía la demandante. Sin embargo, la sentencia acota la intención de reintegro y fija dos condiciones: WiZink únicamente está obligada a devolver las cantidades cobradas a partir del 25 de noviembre de 2015 y se establece un plazo de prescripción de cinco años para cada pago.
En tal caso, se acata la sentencia que tomó el Tribunal Supremo el 25 de noviembre de 2015, la cual permite “a cualquier consumidor que tuviera la tarjeta de crédito advertir de la posibilidad de reclamar el posible carácter usurario del contrato”. Según el juez, a partir de esta fecha el prestatario que ha estado pagando intereses ya “puede conocer su carácter usurario, con lo que ya tiene, o debería tener, el conocimiento necesario que, unido al carácter radical de la nulidad que deriva del préstamo usurario, hace que el plazo de prescripción empiece a correr”.
Por otra parte, se establece el plazo de prescripción para reclamar lo abonado en cinco años porque considera que la reclamación está sometida a los plazos de prescripción que estable el Código Civil para las acciones personales. Así se indica en el artículo 1964.2.
La sentencia también se apoya en la jurisprudencia del Tribunal de Justicia Europeo (TJUE) en materia de prescripción para una acción de restitución derivada de la abusividad de una cláusula. Así, el plazo que la sentencia de la juez de La Vila establece en cinco años, empezaría a contar desde el momento en que el consumidor pueda tener noticia del carácter abusivo.
